Launch status
Public Cloud uploads will not open until Flashback's designated DMCA agent has been registered with the U.S. Copyright Office and the agent's name, mailing address, telephone number, and email address are published here. This is an intentional launch requirement, not a missing form field.
Copyright notice
After designation, a notice should identify the copyrighted work, identify the Flashback URL to remove, include the complaining party's contact information, state a good-faith belief that the use is unauthorized, state under penalty of perjury that the notice is accurate and the sender is authorized, and include a physical or electronic signature.
Do not attach the video. Send only the Flashback URL and required notice information.
Counter-notice
A user whose clip was removed may submit a valid counter-notice identifying the removed material and prior location, consenting to the legally required federal-court jurisdiction, agreeing to accept service of process, stating under penalty of perjury that removal resulted from mistake or misidentification, and providing a physical or electronic signature and required contact information.
Repeat infringement
Flashback will maintain and reasonably enforce a repeat-infringer policy once Cloud opens. Accounts can be terminated where repeat infringement is established in appropriate circumstances.
